The Site is the property of M/s MAAZIAH. By using the website, You Agree to these Terms of Use.
We refer to this Agreement, our Terms and Conditions, Privacy policy and any other rules are collectively termed as “Legal Terms”. You explicitly and implicitly agree to be bound by our Legal Terms each time you access our Website. If you do not wish to be so bound, please do not use or access our Website.

Maaziah grants you non-exclusive, non-transferable, revocable to access and use our website in order for you to make purchases of Tally software subscription license and related services through our website, strictly in accordance with our legal terms..

2. ACCOUNT AND REGISTRATION OBLIGATIONS

If you wish to purchase any items or use the services on this website, you must create a user account / ID (Email address and password) with us and/or provide the required information to us. You must keep your account and registration details current and correct for all communications related to your purchases from the website.
If you provide any information that is untrue, inaccurate, not current or not in accordance with the User Agreement, Maaziah has the right to indefinitely suspend or terminate or block access of your membership with the Website and refuse to provide you with access to the Website.

3. SOFTWARE LICENCE / SERIAL KEY DISCLAIMER

The software License key/Serial key is provided & the software developed by Tally Solutions Private Limited head quartered at Bangalore, India.
You acknowledge that software provided to you is on AS-IS basis and customisation is possible based on your requirements on chargeable basis. Maaziah provides limited support services to its customers for procuring new license and installation will be done has free of cost. These services will be provided off-site and any on-site visits may levy further fees/charges. You will need to contact helpline and customer support services of Maaziah. We do not otherwise guarantee the accuracy or applicability of any Software for your needs. Maaziah and its associated partners does not guarantee that software to be at par to your requirements. Maaziah and its associated partners will not be liable of any loss or damage with the use of these software. You agree to purchase and use software at your own risk.

4. COPYRIGHTS, TRADEMARKS & USE OF CONTENT

All logos, brands, marks headings, labels, names, signatures, numerals, shapes or any combinations thereof, appearing in this website, except as otherwise noted, are properties either owned, or used under licence, by the business and / or its associate entities who feature on this Website. The use of these properties or any other content on this website, except as provided in these terms and conditions or in the site content, is strictly prohibited.
By accepting our Terms of Use you may not copy, acquire, distribute, modify, reproduce, publish, license or sell, re-sell any information, services, or items purchased from or through our site. Maaziah reserves the right to bar any such activity.

5. PAYMENTS & REFUNDS

Before you buy any item through the Website, we request you to review our Fee and Payment Policy. Maaziah reserves the right to change its Fee and Payment policies from time to time.
The Online payments can be made using the following forms of payments, we may withdraw any of the following payment option at its sole discretion.

Refunds
Payment once done is non-refundable. Services once ordered cannot be cancelled. Services once sold shall not be accepted back by the Maaziah. However, we may at its sole discretion consider accepting return of a service and grant of part or full refund in such circumstances.

6.INDEMNITY

You shall indemnify and hold harmless Maaziah and it’s associated partners, affiliates, third-parties and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of your breach of the User Agreement, Company Rules and Policies or the documents they incorporate by reference, or your violation of any law, rules or regulations or the rights of a third party.

7.  LIMITATIONS OF LIABILITY

Maaziah DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH IN THIS AGREEMENT, INCLUDING ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST OR CORRUPTED DATA OR SOFTWARE. MAAZIAH WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY EXCEPT AS EXPRESSLY PROVIDED HEREIN. MAAZIAH SOLE LIABILITY FOR ANY CLAIMS, WHETHER BASED IN CONTRACT OR TORT, AT LAW OR IN EQUITY, FOR ANY LOSS OR DAMAGES ARISING, RESULTING FROM, OR CONNECTED WITH THE PRODUCTS, THE WEB SITE AND THIS AGREEMENT SHALL BE LIMITED TO THE LESSER OF THE ACTUAL AMOUNT OF SUCH LOSS OR DAMAGES OR THE PURCHASE PRICE PAID BY CUSTOMER FOR THE PRODUCTS THAT ARE THE SUBJECT OF THE CLAIM.

8. DISCLAIMER ON WARRANTY

This site www.maaziah.com , and any content available on this site, are provided by Maaziah on an “as-is” and “as available” basis. Neither we nor any of our business partners represent or warrant that this site will be uninterrupted or error-free, that defects, if any, will be corrected, or that this site is free of viruses or other harmful components; nor do we or they make any representations or warranties about the accuracy, reliability, currency, quality, performance or suitability of this site or any content available on this site.
Maaziah does not warrant that the information, content, materials, products or other services included on or otherwise made available to you through this site.
Maaziah, and it’s associated partners, affiliates, sellers and any and all third-party content providers and licensed granters, shall have the right to assert and enforce any and all provisions set forth in these terms of use directly or on its own behalf. These terms of use are to apply equally and for the benefit of all aforementioned parties.

9. GOVERNING LAW AND JURISDICTION

This Legal Agreement shall be governed and construed in accordance with the laws of India.
Any dispute arises between you and Maaziah during the use of the site, the services or alleged breach of any provision of the User Agreement, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by Maaziah. The place of arbitration shall be Chennai, Subject to Chennai jurisdiction The language of the arbitration shall be English.
